Terms and Conditions

1. It is the buyer's responsibility to review and judge vehicle conditions before bidding. Item preview is
highly recommended and bidding without previewing is strongly discouraged.
2. The auction end date and time may be changed without notice to the bidders, please check back often.
3. To allow bidders plenty of time to bid, auction times may be extended if there is bidding activity in the last
few minutes
4. All bidders must register before each sale. Bidding on any vehicle is confirmation of acceptance of all these
Terms and Conditions. Registration could take up to 48 hours to complete.
5. The sales sheet/run list may change at any time. Bidders rely solely on their own observations and
inspections in determining whether to buy a vehicle. Beard’s Towing is not responsible for misinformation
given about the details of the vehicle, including but not limited to, salvage or damaged titles not properly
designated, vehicles mismarked -- running or not, keys with vehicle, etc. The bidder is solely responsible to
research the details and inspect the vehicle they are bidding on.
6. Payment for vehicles must be in CASH ONLY! NO OTHER FORMS OF PAYMENT WILL BE ACCEPTED FOR
ANY REASON. You must pay in exact change, and no change for overpayment will be given.
7. **Vehicles must be paid and removed within 4 days of auction closing. (Auction close day is DAY 1)** Any
late payment will be charged at a late fee of $25.00 per day for up to 4 days, including weekends even though
pick up and payment is NOT allowed on these days. VEHICLE PICK UP WILL ONLY OCCUR BETWEEN THE
HOURS OF 10AM AND 4PM MONDAY THROUGH FRIDAY – no extension past these hours will be granted.
8. Failure to remove the vehicle from the property after payment will result in storage fees of $24.74 per day.
If items purchased are not removed within 10 calendar days (including weekends) after the auction closing
(including the day the auction closed), the buyer forfeits all monies paid and the property reverts to Beard's
Towing with no recourse and the vehicle will be listed again to be sold.
9. Beard’s Towing is not responsible for loss or damage to vehicles that are not immediately paid for and
removed from the property.
10. State law requires all vehicles be titled within 30 days of the date of sale of the vehicle (includes Storage
Lien Packets, Titles or Auction Sales Receipts). Once 30 days have passed, Beard’s Towing will no longer be
able to help you obtain a title. Please apply for title with the State using your provided paperwork before this
time period expires! All winning bidders MUST PICKUP the paperwork in person when picking up the
vehicle.
11. All vehicle paperwork will appear exactly like it is on your invoice. Paperwork will be made out in the
company name exactly as it appears on the winning bidder's invoice. If no company name is provided, then it
will be listed in the individual name instead. Updating your online account personal information AFTER the
item closes will not update your invoice or paperwork information. No changes to paperwork will be allowed.
No exceptions!

12. Beard’s Towing hereby disclaims and excludes any and all warranties of title, including without limitation
that the title is good and its transfer is rightful, and that the vehicle is delivered free from any security interest
or other lien or encumbrance. Beard’s Towing also disclaims and excludes any and all warranties that the
vehicle is delivered free from any rightful claim of any third party by way of infringement or the like. All
vehicles are sold “AS IS WITH ALL FAULTS”, including but not limited to dash lights and mechanical defects.
This is a police impound lot, we do not know the full history of the vehicle. Beard’s Towing hereby disclaims
and excludes any and all implied warranties, including without limitation the implied warranties of
merchantability and fitness for a particular purpose. All items are in UNKNOWN WORKING CONDITION
unless otherwise stated and are sold AS IS, WHERE IS with NO WARRANTIES implied or expressed. By
accepting these terms, you agree to take the vehicle and its contents entirely, regardless of the type of
contents inside vehicle or trailer.
13. All vehicles will be assessed a 12% buyer fee, see the website for details. All fees must be paid in CASH
only.
14. A valid Government issued photo ID is required when picking up all items by the winning bidder. Written
authorization must be provided to the seller allowing a person other than the winning bidder to pick up
items. It is the winning bidder’s responsibility to ensure that the person picking up for winning bidder
understands these terms and conditions.
15. No repairs of any kind. No locksmiths allowed. No gas or batteries can be installed.
16.  ALL VEHICLES must be towed from Beard's Towing premises at the winning bidder’s expense by a TDLR
certified wrecker, including a valid cab card and TDLR tow operator’s license. No trailer, car dolly or tow bar
may be used inside the lot. If proper vehicle/equipment is not brought to remove vehicle from Beard's
property, then Beard's Towing will charge $60 CASH ONLY to move the item out of the gate for you. If Beard’s
Towing removes the vehicle outside the gate for you, any vehicle left abandoned and unattended will be
immediately brought back inside the gate – NO EXCEPTIONS. There will be NO ASSISTANCE or NO
LOADING ASSISTANCE available from Beard's Towing employees for the removal of items won. Beard’s
Towing will provide you with a quote to have us tow the vehicle to a location at an additional cost for you if
requested. Removal is the winning bidders' responsibility.
17. NO APPT IS REQUIRED, HOWEVER, PLEASE UNDERSTAND IT COULD TAKE UP TO 2 HOURS TO
RETRIEVE A VEHICLE AS THE VEHICLE MAY BE BLOCKED IN AND WE ARE CONDUCTING NORMAL DAILY
OPERATIONS AS WELL.
18. All vehicles marked on the auction listing with "HAS KEY" - Keys may be lost, stolen, or misplaced prior to
item removal and may not fit locks or ignitions of vehicle advertised. BE AWARE: due to the wrecked
nature of most vehicles, batteries are removed from ALL vehicles for safety reasons. Your vehicle MAY
NOT be equipped with a battery.
19. Should the winning bidder not pay for an item won, the bidder’s rights to bid on future items will be
immediately suspended. If the bidder would like to be reinstated, the bidder would be imposed a $100 fee to
be reinstated, payable by CASH only in person, prior to being reinstated. This fee will be assessed each time a
bidder does not pay for an item. After three times of non-payment, the bidder will be permanently removed
and will no longer be allowed to bid on future items.
